Anyone
detained at a police station is almost always entitled
to free legal advice and representation. Normally
in the Magistrates' Court there are no costs for
you to pay in relation to the advice and representation
available. However, there is a means test in the Magistrates' Court. It is very difficult to advise you in this very quick outline whether or not you are eligible for public funding. There are a number of factors that are taken into account in relation to your means when making this assessment. We will advise you in relation to completing the Legal Aid forms and we will be able to offer you a fixed fee in relation to representing you if you are not eligible for public funding due to your means. We may also be able to reach and agreement, with you, to spread the costs of your representation if this is appropriate in your particular case.
You will normally be entitles to free representation in the Crown Court. The Judge is however empowered, in certain circumstances and dependant upon your means to make an order that you contribute towards your representation after your case is concluded and if you are convicted of any offence. If you are acquitted then there should be no order for costs.
